| Introduction | “Implementation Measures for Special Tax Adjustments (Trial Version)” (Guoshuifa [2009]No.2) was released on January 9, 2009, which established the new ground rules for transfer pricing in China. Up to now, the trial regulation has been implemented for more than one year.The first contemporaneous documentation for year 2008 has been prepared by December 31, 2009 and the deadline of documentation for year 2009 is due on May 31, 2010. In addition, the due date for submitting the annual disclosure forms for every company is May 31 after the end of the tax year in question. Tax authority has the right to investigate any transfer pricing method or transactions regardless whether the Company is obliged to make TP documentation or not. If the Company prepares nothing in this regard, it will put the Company in a bad situation to defend itself and might cause potential penalty on the tax adjustment.The tax exposure arising from transfer pricing poses a significant challenge to enterprises.
